1. IDENTIFICATION OF THE PARTIES

On one side, “BLUESKYGOLF, S.L.”, hereinafter SIMSPACE GOLF SIMULATORS, with Tax ID number B26954859, registered office at C/ FILIPINAS, 1, 03730 JAVEA (ALICANTE), telephone number 629220572 and email blueskygolfsl@gmail.com, registered in the Commercial Registry of Alicante, sheet A-204850, 1st entry, with the remaining identification details appearing in the Legal Notice, and owner of the domain https://simspacegolf.es/, hereinafter the Website, an online store operating in Spain; and, on the other side, the User who purchases the products offered through the Website.

2. ACCEPTANCE AND MODIFICATION

The purchase of the products offered on the Website shall be deemed formalised when the User clicks the “Finalise” button and receives the corresponding purchase confirmation at the email address provided during the process.

Use of the website and/or the contracting of any service or product implies full and unconditional acceptance of each and every provision included in these General Contracting Conditions, as well as in the Privacy Policy, Cookies Policy and any other specific conditions that may apply, where applicable.

To purchase products, the User must click the “ACCEPT” button. Each product offered in the file details what it includes: product description, final price including taxes, and payment options.

If an obvious material error is detected in the price or contracting conditions, SIMSPACE GOLF SIMULATORS reserves the right to communicate said error to the user and cancel the request without formalising the contracting.

In any case, before purchasing the products, and also during the purchasing process, the User may access, save or print these General Contracting Conditions.

To purchase any of the products offered, it is necessary to register previously on the Website or during the purchase process itself. Access to the Website is free, but contracting necessarily requires registration as a user.

Express acceptance of the Privacy Policy and of these General Contracting Conditions by ticking the boxes enabled for this purpose is an essential requirement to formalise any purchase through the Website.

It is recommended not to continue with the purchase if sufficient or clear information about the products offered is not available.

The User declares that he or she has legal capacity to contract and accepts full and unconditional adherence to the General Contracting Conditions, hereinafter GCC, in the version published at the time of contracting.

The sales concluded are distance sales regulated by the current Spanish legislation on the matter.

The contract shall be deemed perfected when SIMSPACE GOLF SIMULATORS sends the user the order confirmation by email. Said confirmation shall include a summary of the services or products contracted, the total price paid, the booking details and, where applicable, access or delivery instructions.

Although the Website is accessible from anywhere in the world, the sale and distribution of the products shall be solely and exclusively for Spain, including the Balearic Islands, Canary Islands, Ceuta and Melilla. You should also contact us for any suggestion related to orders to be delivered in Spain.

LEGAL LIMITATIONS: Sale to persons under 18 years of age is prohibited. Minors are technically restricted from registering on this Website and therefore may not make purchases, in compliance with legal regulations. Data sent by minors shall not be processed, as the law prevents this.

3. OBLIGATIONS OF THE PARTIES

3.1. Obligations of SIMSPACE GOLF SIMULATORS

  • Provide the services in accordance with these GCC and without breaching contractual good faith.
  • Inform the User, prior to contracting and in a specific, clear, precise and unequivocal manner, of the specific characteristics of the products requested, such as their price and applicable taxes.
  • Make a copy of the text of the GCC available to the user. Likewise, for those products that so require, the Specific Conditions that apply shall be made available to the user prior to contracting.
  • Send the user proof of payment or invoice for the products purchased.
  • Comply with the provisions of consumer and user rights regulations.

3.2. Obligations of the User

  • Fully comply with the provisions of the GCC.
  • Complete the registration forms prior to the start of the contracting procedure with truthful and current information in order to access any of the products offered on the Website. The user also guarantees and shall be responsible for keeping them fully updated while he or she remains a user of the Website.
  • Complete the forms for access to the products with truthful and current information, as such data are necessary for the issue, where applicable, of the invoice by SIMSPACE GOLF SIMULATORS and the collection of the contracted products.
  • Correctly provide the bank details requested by SIMSPACE GOLF SIMULATORS, and pay the price of the contracted products in accordance with the selected payment method and with the rates in force published by SIMSPACE GOLF SIMULATORS on the Website at the time of contracting.
  • Maintain the confidentiality of the information provided and immediately notify any loss, misplacement, removal, theft, unlawful access, or knowledge thereof by third parties.

4. AVAILABILITY OF PRODUCTS

  • Classes and training sessions with an instructor.
  • Access vouchers and memberships.
  • Virtual tournaments and competitions.
  • Rental of sports equipment.
  • Sale of golf products and accessories.
  • Other complementary sports and leisure services.

The specific characteristics of each service or product shall be described in detail in the corresponding file on the website.

All products offered by SIMSPACE GOLF SIMULATORS are subject to availability. If a product cannot be supplied, whether due to subsequent lack of stock or a discrepancy in the updating of a requested product, SIMSPACE GOLF SIMULATORS shall contact the User to inform him or her of this event as soon as possible. In such case, the User shall be informed and may purchase alternative products, or an alternative delivery period shall be offered for the initially requested product.

If said period is not to the User’s liking, or if it is not possible to supply the requested product, the User may cancel the Product order free of charge, and the amount paid shall be refunded immediately, thereby ending any type of liability of SIMSPACE GOLF SIMULATORS to the User.

5. PRICES

The published prices appear in euros and include VAT and equivalent taxes; shipping costs are additional unless you are expressly informed that they are included. The User may know the total amount to be paid before formalising the purchase of the products.

SIMSPACE GOLF SIMULATORS reserves the right to modify its prices at any time; however, the prices applicable to the products shall be those published at the time of formalising the sale and purchase, unless there is an obvious typographical or computer error on our part.

6. PAYMENT METHODS

The prices indicated on the website are expressed in euros and include the Value Added Tax in force at any time, unless expressly indicated otherwise. If other taxes, fees or additional expenses apply, these shall be expressly and itemised before order confirmation.

SIMSPACE GOLF reserves the right to modify prices at any time, although changes shall not affect contracts already formalised. The prices in force shall be those published on the website at the time of contracting.

The means of payment are:

  • Credit or debit card, Visa, Mastercard, American Express.
  • Bank transfer.
  • Payment on the premises, for bookings that allow it.
  • Digital payment platforms enabled on the website.

Electronic payments are processed through secure payment gateways with SSL/TLS protocol and PCI-CSS certification, guaranteeing the confidentiality and security of the user’s bank details.

The User shall be responsible for the cards with which he or she carries out the transaction. SIMSPACE GOLF SIMULATORS guarantees security through the SSL security certificate, an information encryption system that guarantees the security of bank details; no one can share, decipher, read or copy the transmitted information.

7. TRANSFER OF RISK AND OWNERSHIP

The User acquires ownership of the products at the time of full payment of all amounts, including shipping costs.

The risk of loss or deterioration shall be transferred to the User when the User, or a third party indicated by him or her other than the carrier, has acquired physical possession. If the User commissions the transport or the carrier chosen is not among those proposed by SIMSPACE GOLF SIMULATORS, the risk shall be transferred to the User upon delivery of the goods to the carrier.

8. SHIPPING POLICY

Shipments are made through FedEx International Economy from Germany; the delivery time is normally 2 to 5 business days, with coverage in Spain and Portugal.

Shipping costs are calculated in the checkout process according to the delivery location and the size of the order. To check the rates, the checkout process must be consulted.

For order tracking, you will receive a tracking number by email once the order has been shipped, allowing you to follow the shipment on the carrier’s website. For any query about the order or the shipping policy, contact us at orders@secondchance.co.uk.

Delivery times are estimated and may vary due to factors such as weather conditions or carrier delays. Delivery times are subject to change without prior notice. In any case, SIMSPACE GOLF SIMULATORS shall deliver the products to the User within a maximum period of 30 calendar days from conclusion of the contract.

Once the contract has been made, the User shall receive a purchase confirmation email and another delivery email once the order has been handed over to the carrier.

Before placing the order, the shipping costs will be known; these include handling and packaging, as well as transport costs, where they are not included in the price.

SIMSPACE GOLF SIMULATORS shall not be responsible for damage that the package may suffer after being shipped, but shall endeavour to protect all fragile items with the best materials and best packaging practices in order to avoid this type of incident as far as possible.

SIMSPACE GOLF SIMULATORS shall be responsible for claiming from the logistics company for damage caused in the transport of the goods. It is important that, upon receiving the products, you note on the carrier’s delivery note any anomaly observed both in the cardboard packaging and in the contents of the products. By noting such damage on the delivery note, the claim will be more effective.

9. PROCEDURE, CANCELLATION AND WITHDRAWAL RIGHTS, AND LEGAL WARRANTY

9.1. Procedure

To exercise the rights of cancellation, withdrawal and use of the warranty, the User must contact SIMSPACE GOLF SIMULATORS through 629220572 or blueskygolfsl@gmail.com.

9.2. Right of Cancellation

The User may cancel his or her order at no cost provided this is communicated before the order has been made available to the carrier.

9.3. Right of Withdrawal

The User has a period of 14 calendar days without the need for justification and without any penalty. The withdrawal period shall expire 14 calendar days from the day on which the User or a third party indicated by him or her, other than the carrier, acquired physical possession of the goods.

The right of withdrawal shall apply provided that the contracted products are returned in the same conditions, together with their complete original packaging, labels and any related accessories, and are accompanied by the purchase invoice. In any case, SIMSPACE GOLF SIMULATORS shall determine whether these requirements are met.

To exercise the right of withdrawal, BLUESKYGOLF, S.L. must be notified of the decision to withdraw by means of an unequivocal statement sent to blueskygolfsl@gmail.com. The withdrawal form model below may be used, although its use is not mandatory.

Please note that returns must be sent to the following address: Units 1-4 Pipers Court, Amy Johnson Way, Blackpool, FY4 2RT.

Items sent without having previously requested a return will not be accepted.

Consequences of withdrawal

In the event of withdrawal on your part, we shall refund all payments received from the user, except delivery costs, without undue delay and, in any case, provided that we have received the product and inspected that it is in perfect condition, no later than 14 calendar days from the date on which the product has been received.

We shall make said refund using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any expense as a result of the refund. The refund shall be withheld until the goods have been received or until the user has submitted proof of return thereof.

The user must return or deliver the goods to BLUESKYGOLF, S.L., Units 1-4 Pipers Court, Amy Johnson Way, Blackpool, FY4 2RT, without undue delay and, in any case, no later than 14 calendar days from the date of communication of the withdrawal decision. The deadline shall be considered met if the goods are returned before said period has expired.

The User must bear the direct cost of returning the goods.

The right of withdrawal shall not apply to the following products:

  • Products made at the request of the user or personalised products.
  • Products expressly ordered by the user outside our catalogue.
  • Products where the commercial department of SIMSPACE GOLF SIMULATORS so warns because they are special products or ordered by the user and are for very occasional use.
  • Extraordinarily large quantities.

9.4. Legal Warranty

All products sold from 1 January 2022 are covered by a three-year legal warranty against lack of conformity, pursuant to Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users.

The user has a warranty period of three years from delivery of the product. This warranty does not include defects caused by negligence, knocks, improper use or handling by the user. Unless proven otherwise, lack of conformity that appears within six months after delivery of the product shall be presumed to have existed when the item was delivered.

The legal warranty comprises the following rights for the User:

  • If the product is not in conformity with the contract, the User may choose between requiring repair or replacement of the product, unless one of these two options is objectively impossible or disproportionate to the detriment of SIMSPACE GOLF SIMULATORS. All expenses for the exercise of this right shall be free of charge for the User.
  • A price reduction and termination of the contract shall proceed, at the User’s choice, when the User cannot demand repair or replacement, and in cases where these have not been carried out within a reasonable time or without major inconvenience for the User. Termination shall not proceed when the lack of conformity is of minor importance.

Some products are subject to wear according to the frequency and intensity of use; therefore, normal wear is not covered by this commercial warranty, while defects not caused by wear are covered according to the applicable terms of the country. Intensive use does not automatically mean that a product is defective.

Replaceable parts are treated as consumables unless they are defective at the time of delivery.

During the applicable warranty period, the warranty covers: material defects, manufacturing defects and faults not attributable to wear, misuse or external damage.

The warranty does not cover:

  • Normal wear / depletion of consumables.
  • Cosmetic wear that does not affect safe function.
  • Misuse, abuse, negligence, improper storage.
  • Incorrect installation or configuration.
  • Use outside the published product guide.
  • Outdoor exposure for products designed for indoor use.
  • Unauthorised alteration, modification or repair.
  • Damage from third-party equipment or non-recommended accessories.
  • Accidental damage, impact damage outside intended use, flood / fire.

Launch monitors are precision electronic devices and must be placed safely outside the impact areas of the ball. SimSpace is not responsible for damage occurring during use, including, but not limited to:

  • Ball impact resulting from failed shots or “shanks”.
  • Direct-hit damage.
  • Impact caused by rebound.
  • Incorrect placement or configuration.

Accidental impact damage is not covered by this commercial warranty. Customers are solely responsible for damage caused during use. No refunds, replacements or credits shall be provided for impact damage. Where available, the use of protective covers is strongly recommended.

As regards impact screens, wear performance is assessed up to an expected wear life of 20,000 shots. Hitting mats are assessed up to an expected wear life of 40,000 shots. Golf balls are consumable items and are not covered for wear.

A different warranty period may be specified for the products.

Images associated with the products offered are merely illustrative and may not be a faithful reflection of the product, since manufacturers and distributors continuously renew them.

10. NOTIFICATIONS

SIMSPACE GOLF SIMULATORS designates as its address for notification purposes the address stipulated in the Legal Notice.

The email address provided by the User during the registration process shall be used by SIMSPACE GOLF SIMULATORS for the purpose of making notifications.

All notifications made in accordance with the indicated procedure shall be considered validly made.

11. ONLINE DISPUTE RESOLUTION

Pursuant to Article 14.1 of Regulation 524/2013 on online dispute resolution for consumer matters, in the event of any dispute or conflict in relation to the interpretation, validity or execution of these GCC, the parties undertake to attempt to resolve it amicably through direct communication and mutual assistance.

12. DATA PROTECTION

The personal data provided by the contracting person to SIMSPACE GOLF SIMULATORS shall be included in the personal database created and maintained under the responsibility of and in compliance with the General Data Protection Regulation and the Organic Law on Personal Data Protection and guarantee of digital rights, for the purpose of managing the contractual relationship arising from the sale and purchase, including order management, shipping, invoicing and customer service. The processing of the data is carried out on the basis of performance of the sale and purchase contract.

The User may at any time exercise the rights of access, rectification, restriction, erasure, withdrawal of consent and portability of his or her personal data by notifying blueskygolfsl@gmail.com.

Both parties undertake to maintain the confidentiality of all information obtained within the framework of this contract, including personal data, commercial, technical or any other type of information, and may not disclose it without the express authorisation of the other party, except by legal obligation.

SIMSPACE GOLF SIMULATORS may disclose personal data to third parties exclusively to the extent necessary to comply with obligations arising from the contract or pursuant to regulatory compliance, guaranteeing in all cases that these third-party companies comply with current data protection and confidentiality regulations.

13. NULLITY

If any of these GCC are declared null and void by a final decision issued by a competent authority, the remaining clauses shall remain in force and shall not be affected by said declaration of nullity.

14. LANGUAGE

The language in which the contract is formalised is Spanish.

15. COMPETENT JURISDICTION

In the event of litigation between the parties, territorial jurisdiction shall correspond, at the User’s choice, to the User’s domicile or to that of the defendant.
